Terms of Use

1. Who we are

welKaly is operated by Beni RAFA et l'equipe welKaly, Boulevard eugène reguillion 69100. Contact:support@welkaly.com.

welKaly is an app for tracking what you eat, the activity you do, and how your body changes over time. That is all it is. Please read section 4 carefully before you rely on it for anything more.

2. Accepting these terms

You accept these terms when you create an account. If you do not agree with them, do not create one. OurPrivacy Policy explains how we handle your data and forms part of this agreement.

3. Your account

• You must be at least 13 years old to create an account.
• Provide accurate information: your targets are calculated from it.
• You are responsible for keeping your credentials secure.
• One account per person. Do not share your account.
• Tell us promptly if you believe your account has been compromised.

4. Health disclaimer

Your calorie and macronutrient targets are estimates produced by standard nutrition formulas (Mifflin-St Jeor for resting energy expenditure, adjusted by an activity factor and your chosen pace). They are a starting point, not a prescription, and they cannot account for everything about your body.

The values obtained through photo analysis, barcode scanning, and the food database are also estimates. However, we make every effort to use the most optimized formulas to ensure that the results are as close to reality as possible. Please verify everything that matters before taking action accordingly.

Consult a qualified healthcare professional before making significant changes to your diet or exercise, and especially if you are pregnant or breastfeeding, are under medical supervision, have diabetes, a heart condition or an eating disorder, or are recovering from one. Do not use welKaly to restrict your intake in a way a professional has advised against.

5. Acceptable use

You agree not to:

• Break the law, or use the app to harm anyone.
• Attempt to access another user's data.
• Reverse-engineer, scrape, or place automated load on the service.
• Circumvent usage limits, including the daily cap of 30 AI photo analyses.
• Upload content that infringes someone else's rights, or that is unlawful.
• Send images of other people for analysis without their agreement: the camera is for photographing food.

We may suspend or close accounts that breach these terms.

6. Your content

The meals, photos, activities and measurements you add remain yours. You grant us only the licence needed to operate the service for you: storing your entries, and sending a photo to our AI provider so it can be analysed. We do not publish your content, and neither we nor our AI provider use it to train AI models.

7. AI analysis

Photo analysis is limited to 30 analyses per account per day. This is there to keep the feature affordable and to stop abuse; it is not a paywall, and we will tell you in the app when you reach it. We may adjust the limit, and we may pause the feature if our AI provider is unavailable.

8. Price and availability

welKaly does not currently charge for any feature: there is no subscription, no trial and no in-app purchase, and the app takes no payment details at all. We may introduce paid plans in the future; if we do, we will announce it in the app and on this website before anything changes, describe pricing clearly before you pay for anything, and give reasonable notice for any change that affects a feature you already rely on.

welKaly also shows no advertising today. We may introduce ads in the future. If we do, we will announce it in the app and on this website first, and our Privacy Policy sets out the limits we hold ourselves to, in particular that your health data is never used to target advertising and is never handed to an advertising company.

We aim to keep the service available but do not guarantee uninterrupted access. We may change or discontinue features, and will give reasonable notice for changes that materially affect you.

9. Updates to the app

welKaly can update itself over the internet without going through the app store, so you get fixes quickly. By using the app you agree to receive these updates. They change the app itself, not your data.

10. Third-party data

Packaged product information comes from Open Food Facts, a community database provided under the Open Database License (ODbL). It is contributed by volunteers and may be incomplete or out of date.

Our built-in food database is built from public reference data: the FrenchANSES-CIQUAL food composition table and theUSDA FoodData Central database, each used under its own terms and reproduced here for nutritional reference only.

None of these sources is guaranteed accurate. Always check the physical packaging when accuracy matters, for example when managing an allergy.

11. App stores

If you installed welKaly from the App Store or Google Play, that store's terms also apply to you. This agreement is between you and us, not with Apple or Google: they do not operate welKaly, are not responsible for it, and have no obligation to provide support for it. Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary of them.

12. Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, nor for decisions you make on the basis of estimates the app provides. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence.

Your statutory rights as a consumer are not affected.

13. Ending the agreement

You can stop using welKaly and delete your account at any time: see ouraccount deletion page. Deleting your account ends this agreement. We may close your account for a serious or repeated breach of these terms, with notice where it is reasonable to give it.

14. Changes

We may update these terms. The date at the top of this page shows when they last changed, and material changes will be announced in the app. Continuing to use welKaly after a change means you accept the updated terms. If you do not accept them, delete your account.
